Kelly practices in California and Washington state and federal courts in general civil and trial practice, including administrative writ, civil rights, real property, environmental, and business law. He is a licensed California real estate broker.

He is admitted to all California appeal courts, federal district and appeal court, and state and U.S. supreme courts.

Published Decisions and Selected Matters

• Pacific Shores Property Owners Association v. Department of Fish & Wildlife (2016) 244 Cal.App.4th 12. Prevailing decision on the inverse-condemnation statute of limitations where flooding was ongoing, California Third District Court of Appeal.
• Sustainability of Parks, Recycling and Wildlife Legal Defense Fund v. County of Solano Dept. of Resource Management (2008) 167 Cal.App.4th 1350. Established the public right to administrative review of solid-waste facility permits, California First District Court of Appeal.
• Multiple successful litigations under the California Environmental Quality Act and National Environmental Policy Act. Clients include Sierra Club and other environmental groups, including Saltonstall v. City of Sacramento (2015) 234 Cal.App.4th 549.
• Represented clients in contaminated-property suits. Obtained indemnity and damages from an adjacent petroleum-product storage facility; obtained an agreement by a prior lessor and oil company to defend a client “mom-and-pop” service station in an MTBE contamination case.
• Represented landowners in a major downtown Sacramento redevelopment project, with litigation involving CEQA, contract performance, redevelopment law, contamination, and eminent domain, as well as transactional counsel in a major settlement.
